1. Binding Agreement and Acceptance

By accessing, browsing, registering for, or utilizing the services provided by GetWork.ph (operated by Generative Intellectual and its designated affiliates), including our web applications, candidate registries, employer management dashboards, mobile interfaces, and programmatic API endpoints, you enter into a legally binding contract with GetWork.ph. If you do not agree to all terms and conditions set forth herein, you are strictly prohibited from accessing or using the platform.

2. Scope of Marketplace Services

GetWork.ph operates an specialized physical labor and skilled trade staffing marketplace. Our platform facilitates connections between commercial employers, project contractors, business managers, and candidate job seekers across skilled trades, hospitality, retail, manufacturing, logistics, and general labor sectors in the Philippines.

3. Candidate Profile Transmission and Data Sharing

By registering a candidate profile, submitting an application, or uploading trade credentials to GetWork.ph, candidates explicitly authorize GetWork.ph to transmit, display, and share their full candidate profile, contact information, work experience, trade licenses, education, and resume attachments with verified commercial employers, hiring managers, and partner companies. Candidates acknowledge that applying for any job listing constitutes an express direction to disclose their personal and professional information to the prospective employer.

4. Commercial Data Rights and Third-Party Transfer

GetWork.ph retains full commercial rights over the marketplace data ecosystem. By using the platform, users grant GetWork.ph a perpetual, worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to index, process, aggregate, analyze, format, display, and commercialize marketplace data. GetWork.ph reserves the absolute legal right to share, transfer, license, or sell candidate data, aggregate labor metrics, market analytics, and profile intelligence to third-party partners, industry analytics providers, commercial recruitment platforms, and corporate affiliates.

5. Autonomous AI Systems and Algorithmic Matching

GetWork.ph integrates advanced autonomous artificial intelligence (AI) agents, machine learning algorithms, and automated decisioning systems to index candidate skill sets, evaluate job requirements, and generate candidate match scores.

• Automated Processing: Candidates acknowledge and consent to the automated processing and evaluation of their profile data by AI algorithms for job placement recommendations.
• Programmatic Machine API (x402 Protocol): Autonomous machine agents and programmatic software clients interact with GetWork.ph via HTTP 402 micro-payment gateways. AI agents may query candidate registries, execute match queries, and dispatch programmatic work orders.
• Non-Refundable Settlement: All blockchain and micro-payment transaction fees associated with AI agent dispatches and API data requests are final and non-refundable upon network confirmation.

6. Employer Posting Rules and Anti-Harvesting Limits

Commercial employers must provide truthful, accurate, and lawful job descriptions. To prevent candidate data scraping, automated harvesting, and platform misuse, GetWork.ph enforces strict posting quotas and per-job candidate caps. GetWork.ph reserves the right to suspend, audit, or terminate any employer account attempting to bypass quota controls or misappropriate candidate information.

7. Strict Disclaimer of Warranties (No Guarantees)

The GetWork.ph platform, including all contents, algorithms, job listings, candidate profiles, and AI services, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied.

• No Placement Guarantee: GetWork.ph makes no representation or guarantee that candidates will receive job interviews, employment offers, or compensation.
• No Hiring Guarantee: GetWork.ph does not guarantee that commercial employers will find qualified candidates, receive applications, or successfully fill open positions.
• No Site Safety Guarantee: GetWork.ph is not responsible for job site working conditions, physical safety, labor dispute resolution, or employer wage compliance.
• Service Continuity: GetWork.ph does not warrant uninterrupted, error-free, or secure operation of the platform.

8. Limitation of Liability

To the maximum extent permitted by applicable law, GetWork.ph, its parent company, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data corruption, job site injury, or employment disputes arising out of or related to your use of the platform.

9. Indemnification

You agree to defend, indemnify, and hold harmless GetWork.ph and its affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, or fees (including legal fees) arising out of your violation of these Terms of Service or your use of the platform.

10. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with applicable laws. Any legal action or proceeding arising under these terms shall be brought exclusively in competent courts of jurisdiction.
